Service Description
Arkansas Pest Control provides professional pest management services to residential and commercial properties throughout the state of Arkansas. Our services include, but are not limited to, inspection, identification, treatment, and prevention of common pests such as termites, rodents, ants, spiders, cockroaches, mosquitoes, bed bugs, and wildlife. Treatment methods may involve chemical applications, baiting systems, trapping, exclusion techniques, and integrated pest management strategies tailored to the specific conditions of each property. Service frequency, scope, and methodology are determined based on initial inspection findings, environmental factors, and customer-selected service plans. We may perform services at scheduled intervals or on an as-needed basis depending on the nature of the pest issue and the terms outlined in your individual service agreement. All treatments are conducted by licensed technicians in accordance with Arkansas Department of Agriculture regulations and applicable federal guidelines.
No Guarantee or Warranty
Arkansas Pest Control makes no express or implied guarantees regarding the complete elimination of pests from any treated property. Pest biology, environmental conditions, neighboring properties, structural deficiencies, and client behavior can all influence treatment outcomes. While we employ industry-standard methods and materials, we cannot warrant that pests will not return or that reinfestation will not occur. Any warranty or guarantee referenced in your specific service agreement is limited to the terms and conditions expressly stated therein and does not extend beyond the scope, duration, or conditions specified. We do not guarantee against damage to property, personal injury, or economic loss arising from pest presence or pest-related issues. Results may vary, and no refunds or credits will be issued based solely on the continued presence of pests following treatment, except as expressly provided in your service agreement.
User Responsibilities
As a customer of Arkansas Pest Control, you agree to provide accurate information regarding your property, pest concerns, and any prior treatments. You must ensure safe access to all areas requiring treatment and disclose known hazards, including but not limited to the presence of pets, children, individuals with chemical sensitivities, wells, cisterns, or sensitive landscaping. You are responsible for following all pre-treatment and post-treatment instructions provided by our technicians, including preparation requirements, vacancy periods, and cleaning restrictions. Failure to comply with these instructions may reduce treatment effectiveness and void any limited guarantees. You agree to notify us promptly if adverse conditions are observed following treatment and to cooperate with any necessary follow-up services. You must obtain any required permissions for service if you are not the property owner. Payment is due according to the terms of your service agreement, and you remain responsible for charges regardless of perceived treatment outcomes.
Limitation of Liability
To the fullest extent permitted by law, Arkansas Pest Control and its owners, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, lost profits, business interruption, or emotional distress. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim during the twelve months preceding the event. This limitation applies regardless of the legal theory asserted, whether in contract, tort, negligence, strict liability, or otherwise. We are not responsible for damage to personal property, landscaping, or structures that are concealed, inaccessible, or not disclosed prior to service. You acknowledge that pest control treatments involve inherent risks and agree to assume responsibility for any conditions on your property that may contribute to pest problems or treatment complications.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and proprietary information displayed on Arkansas Pest Control websites, marketing materials, and service documentation are the exclusive property of Arkansas Pest Control or its licensors. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our intellectual property without prior written consent. Any feedback, suggestions, or ideas you provide regarding our services may be used by us without compensation or attribution. Our service reports, treatment plans, and technical documentation are confidential and provided solely for your personal or internal business use. Unauthorized disclosure, resale, or commercial use of our proprietary materials is strictly prohibited and may result in legal action.
Governing Law
These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Pulaski County, Arkansas. You consent to the personal jurisdiction and venue of these courts and waive any objection to such jurisdiction or venue on the grounds of inconvenient forum. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision of these terms is held invalid or unenforceable under Arkansas law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Changes to Terms

Your continued use of our services following any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically. Material changes affecting your rights or obligations may be communicated through direct notice when practicable. If you do not agree to any modified terms, you must discontinue use of our services and notify us in writing to terminate any active service agreements.
